For the purpose of this Agreement, a "User" is any person who accesses Pictures India for any purpose whatsoever.

By accessing or using the services of Pictures India, User signifies his acceptance and acknowledgement to the terms and conditions set forth herein.

Pictures India reserves the right to revise / modify these terms and conditions at any point of time, by updating this page, and the User's use of Pictures India after any such revision / modification, signifies User's acceptance to the revised / modified terms and conditions. Therefore Users are suggested to check these terms and conditions periodically for any changes.

Pictures India website may contain links to third party websites that are not owned or controlled by Pictures India. Therefore Pictures India has no control over, and assumes no responsibility for the content, privacy policies or practices of any third party websites. In addition, Pictures India will not and cannot censor or edit the content of third party sites. By accessing the Pictures India website, the User expressly relieves Pictures India from any and all liability arising from his use of any third party website.

Subject to the terms and conditions contained herein, the images contained on Pictures India website are provided Free to Use i.e. to be used by the Users free of cost in presentations, circulations, project reports, brochures, internet sites, TV channels and on internet websites. Pictures India may charge a fee for images of high resolution.

However, some images may contain eminent personalities, celebrities, models, brands or marks etc., which is entirely co - incidental and not intentional. Pictures India expressly disclaims any association with such celebrities, brands or marks and imposes a restriction on the Users to use such images commercially. The User agrees and acknowledges bearing the sole liability in case any dispute arising out of use of such images by the User.

Pictures India / Compare Infobase Limited own and retain all rights, title and interest in and to all of the intellectual property rights including the copyright of the images. All rights arising out of any compilation or derivative work created using any image shall not entitle the User to use any image except as permitted hereunder.

The User agrees not to edit / modify an image in such a way that the result product / image is false, inaccurate, misleading, defamatory, libelous, unlawful, threatening, harassing, abusive, tortuous, vulgar, pornographic, indecent, invasive of another's privacy, hateful or objectionable on the ground of racial, ethnic, castism or regionalism. The User specifically agrees and acknowledges that Pictures India shall not be liable for any modification / edition of the image.

User expressly agrees that use of Pictures India is at user's sole risk. Neither Pictures India, its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that Pictures India will be uninterrupted or error free, nor do they make any warranty as to the results that may be obtained from use of Pictures India, or as to the accuracy, reliability or content of any information, service, or merchandise provided through Pictures India.

Pictures India is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.

In no event shall Pictures India, or any person or entity involved in creating, producing or distributing Pictures India or the Pictures India images, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use Pictures India user hereby acknowledges that the provisions of this section shall apply to all content on Pictures India.

Pictures India makes no warranties, nor shall Pictures India be liable for any claims related to or arising from the User's use of the images which (i) has been edited / modified by the User or (ii) has been combined by the Users with other pictures or (iii) has been used by the User ignoring the restriction imposed under Clause 6 herein before.

User agree to indemnify and hold harmless Pictures India and its officers, directors, employees, contractors and subsidiaries against all claims (including without limitation, claims by third parties) liability, damages, costs including Attorney's fees and all other legal fees and expenses arising out of or relating to (i) User's breach of any terms, conditions or restrictions contained herein in this Agreement, (ii) User's modification / editing of the images or (iii) any other act or failure to act by the User which attracts disputes.
